Terms and conditions

Under these purchase conditions, Okaido Sushi informs users of its owned Website/App (hereinafter referred to as “the Page”) about the purchase conditions that govern access to the services provided by Okaido Sushi. The use of the Page attributes the status of “User” to any natural person of legal age interested in Okaido Sushi’s products and services and implies full and unreserved acceptance of each and every provision included in these Purchase Conditions, in the version published by Okaido Sushi at the exact moment the User accesses the Page. In the event that a minor uses this Page and places an order, it will be understood that it has been done under the supervision and consent of their parents or guardians. The User declares to be of legal age and is entirely responsible for the truthfulness of this declaration and has the necessary legal capacity to contract the services offered on the Page in accordance with the conditions set out herein, which they declare to understand and accept. Both access to the Page and its use by the User, as well as the products offered and accessible through it, are subject to applicable legislation and the principles of good faith and lawful use by the User, who will be entirely responsible for such access and correct use. The use of the Page implies total acceptance of the aforementioned Purchase Conditions.

The User may access the General Information of Okaido Sushi in the “Privacy Policy” section of this Page.

Purchase/Return/Delivery

The management and delivery of the order requested through the Page will be provided by the companies owning the “Okaido Sushi” brand Restaurants associated with it. Therefore, the company owning the “Okaido Sushi” Restaurant where the order was placed will be the contracting party in the purchase of the requested order, being solely responsible for the sale, its distribution and delivery, as well as issuing the ticket or invoice and, where appropriate, collecting the payment. Nevertheless, Okaido Sushi is the company that manages the Page and coordinates the ordering process or the resolution of possible incidents on behalf of the aforementioned “Okaido Sushi” Restaurants.
The User may place an order through the website, where they must choose the restaurant and then indicate the pickup time, number of people, and promotional code, if available. Once these options are selected, the User can choose the dishes listed in the Menu section and add them to their cart. The screen will display the selected products with the final price (VAT and delivery costs included). Delivery charges depend on the user’s postal code:

  • 29720: €1.50
  • 29730: €1.50
  • 29738: €1.50

If the User has selected the “Home Delivery” option, the minimum order amount will depend on the user’s postal code:

  • 29720: €15.00
  • 29730: €15.00
  • 29738: €15.00

If the products selected by the User do not meet the minimum order, the purchase process cannot continue.
Once the products are selected and the purchase price is determined, the User will be asked to provide certain personal data necessary to process the requested order. The form will indicate the mandatory fields for the purchase process. Refusing to provide the mandatory data will result in the inability to provide or access the service for which they were required. To this end, the processing of personal data of the Users of the Page will be carried out in accordance with the provisions of the “Privacy and Data Protection Policy” and “Cookie Policy” of the Page, which we ask you to please read. Only natural persons of legal age may request and contract the order service through the Page; that is, the e-commerce portal offered by the Page is intended for adults. The User declares and guarantees that they are of legal age and are entirely responsible for the accuracy of this statement and that the data entered in the registration are true and correct.

Cash refunds are not accepted. However, if there is any problem with the order, there will be an option to remake it by contacting the restaurant.

In accordance with Law 11/2010 of December 17th on the prevention of alcohol consumption by minors, it is prohibited to sell alcoholic beverages to persons under 18 years of age, or for persons over 18 to purchase on behalf of those under 18. Orders containing alcohol cannot be accepted by individuals under the age of 18.

PAYMENT

The User is obligated to make payment for the contracted service upon delivery of the product, either at the User’s address or at the “Okaido Sushi” Restaurant where the product is to be picked up. At the User’s address, payment can be made in cash or by card, or payment may be made in advance via the website. If payment is made at the Restaurant, the User may also pay in cash, by card, or in advance through the website.
Okaido Sushi processes its payments through a gateway that ensures transactions are carried out in a secure environment based on the PSD2 regulations, which change the European regulation applied to payment services. This gateway complies with all 3DSecure protocols by redirecting data to secure servers without the merchant being able to access or store them. The connection to the gateway and our page is always made through a secure SSL protocol.

One of the PSD2 rules with the greatest impact on commerce is SCA (Strong Customer Authentication), which requires authentication of all European e-commerce transactions, meaning they must be processed as 3D Secure.

Subsequently, the User must verify the data and confirm the order. If everything is correct, the User must select one of the following options depending on the payment method (“Confirm,” “Send Order,” or “Continue with Payment”), which will complete the purchase process and confirm on the Page that the order has been successfully placed. Immediately after contracting the service, the User will receive an email at the address provided, for the purpose of “Order Confirmation,” along with the order details.

This merchant agrees not to permit any transaction that is illegal, or considered by the credit card brands or the acquiring bank to be potentially damaging to their goodwill or negatively affecting them. The following activities are prohibited under the card brand programs: the sale or offering of a product or service that is not fully compliant with all applicable laws to the Buyer, Issuing Bank, Merchant, Cardholder, or cards. Additionally, the following activities are explicitly prohibited: “Sale of alcoholic beverages to persons under 18 years of age.”

Regarding Internet access via mobile devices, the User must have all necessary equipment and software to use the service, as well as a properly configured connection for access. Internet access via mobile devices may incur additional browsing charges from the service provider. The amount of these charges will depend on the rates and conditions that each User has contracted with their mobile operator, and under no circumstances shall Okaido Sushi be held responsible for such costs.

The User may file a complaint or claim regarding the service provided on the Website at the address okaidosishi@gmail.com, which appears in the Contact section of the Website, and Okaido Sushi and/or the franchisee who is attending or has attended the User will contact them at the email address provided to respond as soon as possible. Likewise, complaint forms are available to the User at the “Okaido Sushi” Restaurants.

Right of Withdrawal.

Okaido Sushi informs the User that it is not obligated to provide the consumer with a withdrawal document to revoke the contracting of the service offered through the Page within legal deadlines, as it falls within the exceptions established in Articles 102 and 103 of Royal Legislative Decree 1/2007, of November 16, approving the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, under which the right of withdrawal does not apply to contracts for the supply of goods made to the consumer’s specifications or clearly personalized, or which by their nature cannot be returned or may deteriorate or expire rapidly.
